Plaintiff’s motion to compel deposition and production of documents. No opposition. Motion granted in part and denied in part. The motion to compel production of documents is granted. Defendant is ordered to provide all documents requested without objections by 10/25/10. The motion to compel deposition is denied. The parties stipulated that defendant would provide the documents on a specific date and defendant failed to do so. However, the parties stipulated that the deposition would be taken “after the hearing on the demurrer.” No specific date was set. Plaintiff must re set the deposition for a specific date. If defendant fails to appear, then a motion would be appropriate. The request for sanctions is denied. Plaintiff failed to state the amount of sanctions sought in the moving papers. Including that sum in the reply is not sufficient. Plaintiff’s request for judicial notice is granted.
