It appears that the briefs have been filed and that the parties asked for additional time in which to negotiate. Thus, the ICC has given the parties a larger window with a drop dead date of May 31, 2005. This is good news for the following reasons:

1. The UK action means nothing because it is set for trial after the drop dead date.
2. The only reason for this time extension is for a settlement inclusive of 3g. The arbitration covers only the 2 and 2.5g matters cited in the 8k.
3. Finality is here for the Nok chapter of the book.
4. If the matter is not settled, IDCC will still have a final award ready for the Samsung arbitration. If the matter settles for both 2 and 3g, I would anticipate that Samsung will also execute an amendment to its license including 3g.

I see no downside to this announcement. We now must await earnings and the 10k.

Things to expect from the bashers that mean nothing because the ICC controls the issues.

1. The decision is put off to protect the board members running for reappointment. Nope, IDCC cannot control the ICC.
2. The panel must be waiting on additional evidence that will help Nok. Nope the evidence is closed and a final award date has been set.
3. IDCC will crater as usual. Not this time!!!!!!!!!!!

It is my belief that the tribunal will make its decision and forward it to the ICC where it will be checked over and held. Absent hearing from the parties that all issues have been settled with terms supplied, the award will be finalized on the 31st of May.

The time will be needed for the 3g license and contact with Samsung to settle their side. IDCC and Nok are not going to lower the rate on 2g to get 3g unless Samsung agrees because 2g is still the only official subject of both arbitrations.
