Question..Had Nokia bought out all the NAMED Triggers , or some had gone belly up..and Nokia refused to establish a rate...there would be no catch all clause in a Business contract to Arbitrate a fair and reasonable rate? Ericy was a toss of the coin from exiting the business and Qualcomm had exited the Business..while IDCC and Nokia were framing their contract...We do know there was a Binding Arbitration Clause..How does your Partner know its actual wording? TIA


Your second question is one I have debated with my partner for the last year. He believes that if there is never a trigger, Nok will owe us nothing for 2g forever. His rationale is that a contract is a contract and we received consideration for entering into it no matter how stupid that might seem to us on this board.
