We simply have to win every dispute with Nok. I do not possess the necessary facts concerning the past dealings between Nok and IDCC with respect to 3g to guess at how IDCC will handle this recent challenge. If the facts demonstrated that Nok led IDCC down a path through misrepresentations of material facts, I would cross claim with every theory presently known and a few new one's seeking both actual and punitive damages. This will lock Nok into the litigation even though they suddenly offer to drop their patent challenges. This would level the playing field quickly.
My problem is the potential for additional waiting for the company to reach maximum value for its shareholders. I believe the street will not fully jump into this stock with this new cloud on the 3g outlook. The street is well aware of the 2g saga and will take the Nok challeneg far more seriously than posters on this board. Long term earnings predictability is a must for our analysts and analysts who are contemplating jumping on board. The only thing that will be clear from the arbitration will be 2g through 2006.
I read where some have said what about 3g for years up to 2007. If a trigger license can be secured, then I believe the stock price and the street coverage will rapidly advance toward the 100 target. I believe Nok is counting on the trigger companies to remain unlicensed through 2006. This is why I think E/SNE is so critical at this time.
I do believe that IDCC is in a much better position to defend its 3g patents and based on the representations of the management expect a win in the final outcome. It is the delay that concerns me because I have been chasing this rainbow for many, many years.
I expect to be questioned by many. All I will say is that good lawyers do not file temporary bandaid actions to gain a better short term bargaining position for clients if there is a chance of getting that client slaughtered by a jury in the future. I am assuming that Nok has good lawyers and this is why I take the 3g patent challenge seriously.
