Best case scenario is that Gerber does just that and approves the EC plan. But he'll need to approve recinding exclusivity first.

Barring him ripping it up, perhaps he will throw it back at them and say "fix this and that, or else". Just from reading about Gerber, I seem to think he will find something unseemly about the debtors plan.
