BUT, if what you say is true, RDG013:

Then why did Rosen continue to stonewall the EC with respect to discovery? Why didn't he give up ANYthing, of even SOME value? I'm beginning to think that an examiner (in this particular case) just might not be all its cracked up to be. Moreover, Rosen's new POR threw a crummy $50million additional dollars to the preferreds. And nothing to common. Collectively, these actions don't appear to be the work of someone who is mortally afraid of an examiner being appointed. Either he's stupid (which he's not), or he knows that it will lead nowhere. IMO, we're investing too much hope in such an appointment.
