That is it in a nutshell. Susman going for an examiner and probably expecting a denial was his way of stepping up the pace. FDIC/JPM now will expect a different lawsuit for the illegal nature of the seizure if the POR as it stands is accepted. The thought of a trial with jury (against Susman) is where I believe a just settlement will come into play. They would not want that…plus think of the unwanted exposure.IMO
