I am speculating just like everyone else here, but I would think WMI’s team of lawyers know a lot about this Judge. If they did not beforehand, I am sure they do by now. They are in this high profile case because they make very few mistakes. They have probably known for a long time that an EC would be coming and that they probably would not be able to get out of it if they felt the Judge wanted pre-seizure commons to get something. Sometimes you have to read between the lines and the statement was possibly made to say that now is the time for the EC.

And sometimes you have to read between the words.
