wonder who the "controlling block" shareholder(s) is/are?

With either 98million or 70 million OS or so(depending if Bingaman's shares were cancelled or not) then a controlling block shareholder would have to control a minimum of 35 million shares. I truly hope this deal with ITI turns out, however I am not sure how such a deal could occur without a proxy vote. Does the average shareholder have absolutely no say in anything?
