That raises an interesting question. Say the 8k shows TWK having some tangible assets or at least assets that may result in a positive net worth. Then what happens, and who decides?

I thought they were essentially in liquidation, but it was mentioned that actions were taken to preserve the value of the NOLs. Those are only valuable if they become viable again. (And if they do, the preferred might not have to be paid off/converted, although they still would have to catch up on dividends.) And how much capital might it take to be a viable 'insurance' (or investing) company again?
