Intel is avoiding SOI because of IBM patents, not because they don't need it, right?

No, IBM and Intel have a patent cross license. This license was used by Cyrix in the past to avoid the Intel patents when IBM was its foundry. Others currently use the IBM foundry for that same purpose.
