SAM I believe the agreement called for notifications to be sent to each party in the matter of the breach within thirty days. I don't know who followed the process and the other peices of the puzzle, but then you don't either. In this case the first filer is usually in the right the counter suit is a slap suit to burn up money and time of the first filer. I have been in both positions so I know where of I speak. But allow the process to work itself out. This probably wont take long as it is one of those "who has the documentation" processes.
