Intel's problem is it is treating this as simply a legal issue.

Intel should treat this as a legal issue because it is indeed a legal issue -- no sarcasm meant. The best practice in a legal contest is to say nothing until eventually you have your day in court. Any thing you say before then can and often will cause problems.

It is hard to remain silent when the mud is getting tossed but it is the best thing to do.
