The original theme for AMD was that because of anti-competitive acts of Intel we can't sell our superior processors and gain more market share. Since the filing of the suit, AMD has increased market share and obtained entry into Dell.

Now that AMD has increased market share, the argument that Intel prevents us from selling stuff gets a little weak. It seems that AMD -- through its lawyers -- is offering a slightly different theme that yes we can cell our superior processors but the anti-competitive conduct of Intel prevents us from selling the even more product needed to reach the 30% required for a viable business.

Put another way, the original AMD theme implied that "we are doing well but we would do better if it wasn't for big bad Intel." Now that AMD is doing a bit better with increased market share the position is that "the correct amount of "better" is 30% or we can't make money".
