I have a different view. Very basic analysis 
He simply documented in the late filing he would file on 5/21.   He's likely unaware of the 5 day rule like so many people on this board counting days etc
All he needs to do is understand the rules and comply.  For me it's disappointing but doesn't change where things are heading and the expectations future outcomes 
Some peeps will add down here others will throw in the towel
