Well, not necessarily. If they are putting IPE in their formulary ONLY for triglyceride lowering indication, then they are not technically infringing. And I highly doubt any formulary has generic IPE listed under cardiovascular disease (as it is not even approved for that indication).

Now, that doesn't mean that their INTENTIONS are pure. They may know full well that scripts are being filled for CVD indications. But they can just play stupid.

This goes back to the whole idea that the industry is completely messed up.
