Ordinarily, I don't comment on legal questions, because I'm not a lawyer. But in the recent supplemental update by the defendants in the NWBO case, they cite the Phunware case that survived the MTD saying that "Spoofing" occurred seconds after a price point as compared to the NWBO claim that "Spoofing" occurred within an hour of posting a price. Logically, if "Spoofing" is illegal reflected by a law on the books, it's illegal no matter when it occurs!!!

The defendants are admitting to breaking the law with their illegal "Spoofing" AND suggesting that somehow it's "OK" if it occurs at comparatively different times.. in the Phunware and NWBO cases. If I were a defendant, I'm not sure I'd pay my legal bills for presenting such a brilliant defense.
