Capt, yes, the chances are "better than zero". I agree. The downside is the time that it will likely take. Minimum 2 years.

If Amarin was a BP, and there was no plans to sell anytime in the future, then I think this would have more positive bearing.

And unfortunately, this case will likely still be going on while Sarissa is attempting to sell the company.

Lawsuits just take forever.
