Ok so Mitsui signed over a patent then it was Mitsui’s patent to sign over. If it was BioAmbers patent it would have already been assigned so It must have been owned by Mitsui and BioAmber was allowed to use it.

If this is your theory, Then LCY Chemical would've had to pay Mitsui to give up their security agreement & IP Collateral agreement w/ Bioamber?

Bioamber did assign their patents and trademarks over to Mitsui via Security Agreement & IP Collateral Agreement in exchange for Mitsui's equity (6,600,000 million shares) and $1.00 USD.

Refer to Pages 9-20 in the following link
https://legacy-assignments.uspto.gov/assignments/assignment-pat-43576-72.pdf

Per the PWC's Bioamber secured creditors list, Mitsui's total owed was $4,416,203 CAD or $3,400,476 USD.

All this while thinking "WHY" LCY Biosciences shipped 6,922,080 kgs ($13,844,160 @ $2.00 per kg or $17,305,200 @ $2.50 per kg) of bio-succinic acid to Mitsui, w/ the last shipment in December 2022.
