The original takings cases have been defeated yes.
The bulk of the takings cases died (and were subsequently dropped) when the federal court of appeals ruled against plaintiffs 3-0 on takings, and SCOTUS declined plaintiffs petition to review that decision earlier this year.
The only two takings cases remaining are 1) Wazee (which is the same case plaintiffs already lost and SCOTUS declined to review, but they are asking for an en banc petition for the entire liberal federal appeals court to review their own 3-0 decision which is extremely unlikely) and 2) Kelly (which only really represents direct and derivative claims on behalf of JPS holders and their contractual rights at the time of 2008 cship as opposed to the 2012 NWS which is what the other takings cases were focusing on).
