WronGGG!!! The transaction of CMW selling (directly or via a nominee) based on a false representation is the only thing that matters. The resale by the buyer to a new buyer is only relevant if the Buyer #1 is aware of the false info and sells to Buyer #2 without telling Buyer #2 about the falsity, then Buyer #1 is committing fraud on Buyer #2.

Buyer #1 has been defrauded by CMW whether or nott Buyer #1 ever sells.

The date of the fraud is the date Buyer #1 bought in reliance on false info from CMW. THAT is when the clock for the SOL starts. Resale is irrelevant insofar as CMWs liability is CONcerned. The resale date, fi any, is only relevant to the fraud liability of Buyer #1.
