Yes, although there is a lot more timing discretion for good news compared to bad news. There's case law holding that investors expect good news, so a delay in that case would not change their conduct compared to a setback. The SEC is not in the business of protecting people who aren't already invested in a company, although those people may otherwise be more affected by a good outcome (having missed out).

My guess is that Missling is taking time now to try to find further support for his 2-73 platform drug thesis.
