By virtue of his response to my original statement, it infers a contrary position. If ATVI settles they will pay for infringement. They will not pay for attorney fees that would NOT ordinarily be part of a trial win. When the other poster makes an ambiguous statement, "percentage going to the attorneys IN ADDITION to what Tom and major shareholders want to get"...A settlement is one lump sum amount - no in addition. The attorneys simply take a portion of that amount based on the contingency agreement. WDDD and counsel have in mind a minimum amount they will accept, which of course takes into account the legal fees. Ultimately, those funds come from ATVI, but is entirely different than ATVI paying legal fees for WDDD, which was the original point that I disputed. My read of your statement - based on the IN ADDITION to language is that the settlement would be higher because of the legal fees owed. As I said, perhaps I misunderstood your post, but was trying to clarify the original misleading statement by another poster that legal fees are paid by the losing party. It can happen, but it is rare.
The amount WDDD wants is the amount they are suing for. What they get in a settlement would be far less, as it is a compromise.
