100% false. The judge has no say on whether a corporation can be suspended from public trading by the SEC. The judge decides who is in charge of the company. David lazar & Synergy Management both had tickers suspended that they were custodians of. They went to the judge and asked to be relieved of their custodial obligation when that happened.(it was granted)

The SEC does not care who is in charge of the company when they suspend it unless they plan to file charges. If they decide the entity is a vehicle for illegal activity it is their decision to make.(you can always try and involve a judge by suing the SEC)
