OK, fair enough. So, then I should ask it this way. If the court decides in favor of USRM (odds IMO 75%), will the FDA issue another lawsuit with different wording against USRM?



Which court??

There's two courts involved here now -


1) The appeals court - who's only two options are a) Uphold the injunction and USRM is done or b) Remand the original case back down to the lower court = the case goes on and it will be a long, long time before completed and reaching a final "verdict" or decision in that district court.

2) The original district court and FDA lawsuit - that only "continues on" if the appellate court remands the case back to them (again, If the appeals court upholds summary judgement = over and done for USRM essentially). One must define finding "in favor of USRM" which per the original case filings = "SVF is not a regulated as a drug by the FDA per section 1271.xx blah blah blah".

What happens then - who knows? Can or could "SVF procedures" still be regulated to some degree - of course. As has been pointed out - they'd likely be regulated at least to some degree via "state licensing boards" or "medical boards" etc.

The FDA can not re-sue USRM for the same issue if they were to eventually "win" in the lower court?

What EXACTLY is the question and the point of the question? It's not making any sense at all ?
