Intel is generally not involved and leaves it up to outside counsel. I am sure they chose King and Spalding specifically for this case as they are a rather large and experienced firm.

I suspect most of what is in the response is boilerplate from other briefs as this case is not that unique.

I still don't know if HDVY believes their case was weak or strong, or if they were trying to get Intel to settle... Which Intel never does.
