The Panel judges are expected to be faithful to their oath of office. That did not happen here. Singer's briefs should have achieved a reversal strictly on the briefs. As a matter of fact, Singer's brief was so well constructed, IMO, that it exposed the naked failure of the Judges. The complexity of the underlying subject matter played into the hands of a savvy Defense.

A scientific truth doesn't become untrue just because skillful misrepresentation makes it that way, or when Judges fail to recognize it. So irrespective of the court's 3-0 decision, 1+1 still = 2. The Federal Circuit better take heed, because the truth eventually comes out. The sooner they address the injustice done to Amarin, the less damage control they will have to contend with later down the road.
