north, standing ovation for pointing that truncated material in that brief should be point 1 in an en banc petition. Just throwing this out there, but after Singer's en banc brief is filed, there is a 14-day window to file an amicus brief in support of the en banc petition.

It dawned on me today, the potential for filing an amicus brief making the point that this entire process constitutes a fraud on the court, and upholding both Judge Du and the Panel will mean that the Federal Circuit is endorsing a fraud upon itself.

Two points would be made in support of that conclusion: (1) the cropped table issue would be fully hashed out once and for all; and (2) attach the Bhatt paper, pointing out that the entire decisionmaking process is fraudulent error, and that turning a blind eye to this would amount to a miscarriage of justice.

At this point there is nothing to lose. In terms of this court proceeding Amarin has enough time for one play, and needs to heave a Hail Mary to the end zone.

What do you think?
