As far as the return of ill gotten gains is concerned, I've learned convicted scammers simply have their lawyers tell the court they're too poor to cough it up so there is no additional consequence, i.e., prison time. They simply walk away, free to start another scam.
I've also learned convicted scammers who actually do serve time in prison return to scamming, and, in some instances, actually conduct a new scam while serving time in a prison.
This implies conducting a scam is quite easy to do.
