At one point MaxD and Attia seemed to have an agreement to split the NET proceeds (after the lawyers were paid their contingency) but then the agreement changed. MaxD has been secretive about the precise terms. It was never 50 percent. It was more like a third, but now we have no idea what the share is. And we don’t know if MaxD is on the hook for the counterclaim. But anyway, there is no chance Attia can win anytime soon. The best that could happen this fall is that Attia doesn’t lose the motion to dismiss the trade secrets case. Attia has to make it to trial in September 2020 on a claim of substance, worth more than the counterclaim to win. MaxD has to receive a share greater than the amount it owes Google for shareholders to benefit.
