Minutes are as follows:

The Court convened a telephonic status conference at the request of the FTC. The conference was limited to one point of inquiry: Whether the Court would like Dr. Yarbrough to be present at oral argument on October 29, 2019. IDI objected to the FTC offering any testimony from Dr. Yarborough as the Court scheduled argument on the motion and not an evidentiary hearing. After reviewing her July 30, 2019 Court Order, Judge Fischer reminded the FTC that she cannot tell it how to present its case, but did note that nowhere in her Order is the FTC directed to bring Dr. Yarborough and the Court is more than capable of making such a request. Judge Fischer reiterated to counsel that she has already read the reports, transcripts, and briefing. The Court ordered preparation of the transcript costs to be borne by the FTC.
