Once the broad and overreaching 4617(F) protection goes away and FHFA comes under APA juridiction, FHFA can not do what ever it wants. All FHFA's actions will come under scrutiny of APA.

BTW FHFA has done so many lawless things in the past extending 4717(F) protection to counter parties. In the trial FHFA can not hide all these things. Probably all the previous officials will be called as witnesses. These trials will be very messy and liars will pay big price.

If plaintiffs can prove that FHFA misled investors and violated laws to impose conseratorship, tried to destroy private shareholder companies and harmed investors there will be serious consequences.

The best option would be to wind down conservatorship, SPS and Warrants as soon as possible and persuade investors to drop the lawsuits.
