After following all your posts on the supposed interim on efficacy being performed in 2015, I have to agree with your reasoning. The ruling covers up to the moment in time to 2017 when the judge issued it and that covers 2015 as well and not just 2014 as the shorts claim. Evidently if the 2014 claim was shot down, the shorts could refile since they were adamant the interim for efficacy was conducted but that did not happen. Instead I believe NWBO conducted a blinded analysis to save alpha. The fact that they chose this strategy to “peek” at data and manage the trial accordingly is driving the shorts nuts.
