Good question, in a way. But penny scammers tend to follow familiar patterns. Granted, the older scheme apparently hadn't worked out for the Man Behind the Curtain in the end, but who knows? Maybe he was able to hang onto a lot of money the SEC didn't know about.
Several of the perps in the Texas case announced the other day were recidivists. Either they don't know how to do anything else, or they feel the risk is worth taking.
