Basically... attorneys are allowed to lie before PTAB and say things that wouldn't be allowed in a "real" court. We simply call that "advocacy".

I have said it often... Finjan will rue the day they sued Cisco. Just wait until the counter-claim is decided for Finjan's failure to honor a Non-disclosure Agreement (NDA) with Cisco.
By the way.... Did you notice Judge Freeman stated it was a "average, garden variety $10 million case". I know most think it was much higher, but it isn't. None of their remaining cases are worth much since the appellate court shot down their method of computing royalties at $8.50/user. That is why Symantec became $65M right after they guided $500M and there is nobody left worth much more than $10M.
Their whole business plan now is to do nothing and collect salaries for years until the money dries up. They shut down CybeRisk and Finjan Mobile is a flop. They'll give away a small license once a quarter to maintain the illusion.
