That's just procedure, the Judge doesn't know what was filed until the clerks tell him, he just knows he had a hearing scheduled and Chen didn't show. He makes his judgement and moves on.

The clerks being behind happens all the time, they got a quite a pile to go through everyday. It doesn't help that he filed on a Friday.

It may be a scam, but if its a good one I can make money too!
