They can't get financing from that deal. The 59 days expired a long time ago. plus ALKM doesn't have enough shares authorized to allow conversion of the toxic notes.

The other problem is that ALKM has disclosed it is only trying to file the 10K for the year 2015. This will leave them seriously delinquent and subject to possible SEC enforcement action for violating securities laws.
