Capital Gains Tax Rates The Internal Revenue Service (IRS) taxes long-term capital gains (that is, on assets held more than a year) at different rates than other types of income. Under the Tax Increase Prevention and Reconciliation Act of 2005 (TIPRA) passed by Congress in May 2006, U.S. taxpayers in the two lowest tax brackets (which account for about two-thirds of all individual tax returns) pay no capital gains taxes.
