He has lost every Preferred case

That's a unique perspective since Fairholme (a la Sweeney) is the only active case Berkowitz is involved in. It has yielded the most important information to come out of the FHFA/Treasury thus far, but I guess that's considered "losing" by your standards.

I'm hearing significant rumors about how Berko is closely working with Corker/Warner to make sure Commons don't see a penny. That would really be a painful lesson in capital structure. Hope that doesn't happen, but I guess we'll have to wait and see.

Since he's lost every case though, I guess it's nothing to be concerned about :)
