Lies are tough to prove because they require an intent to deceive at the time the statement was made. Some folks automatically assume lying when things don't pan out the way he said, but that's just failure to deliver, not lying in the eyes of the law.

One thing in his favor, he hasn't been stopped by the SEC in the past 12 years, so he's got that going for him...if he has tracks that are illegal, he knows how to hide them well. He also might be getting too complacent and will make mistakes.
