To your point, look at Staples. After years of trying to merge with Office Depot, Staples has agreed to a "go private" transaction with a private equity firm.

The deal has not closed yet, both Staples and the equity firm are shopping all the Staple retail stores.

Under your scenario, nothing could said.

And yes, Staples has filed numerous SEC filings.
