If CVM and InVentiv have the case move forward and CVM wins, then

1) CVM has agreed to repay the capital expenditures by Lake Whillans to that date in full

2) CVM has agreed to pay $5 MM to Lake Whillans, Plus 15% of the Net Proceeds

So - part of what CVM owes them out of a settlement is clear (point #2), but the other part (point #1) could add some onto the bill depending on what 'capital expenditures' includes.
