KK cannot do anything with the windfall until GERS/he gets it, pays off C&C and YAGI (remember they get a piece of this) and files SEC Form 8K. Also, remember that at least one of the defendants is also publicly traded (PEIX) and will also have to issue a Form 8K. There is no way to keep the windfall quiet; there will be a lag time from the announcement to the distribution (which could be substantial); these are the factors that I am BANKING on, not what else KK may do with the settlement windfall later.

The most telling component of this market fuel will be what, if any thing, is stated about the real prize here -- all of the other infringing companies that are not currently defendants. Some very deep-pocketed such as Valero are included in this large list which dwarfs the current defendant list in number and back royalties due GERS. That fuel could cause a lot of folks to rush in where more experienced hands fear to tread.
