According to the Clerk of the Federal Circuit Court (202-275-8000) case 17-1832 (Greenshift) is stilled "stayed" as of today. I am not an attorney but reading this language literally (Should the mediation prove unsuccessful, the parties will submit a briefing schedule for the Court’s approval by May 19, 2017) implies to me that the mediation/settlement discussions have not broken down to the point that would generate submission of a briefing schedule -- yet.
