This conclusion must assume that the appeals panel is presently leaning heavily on the side of total dismissal. Otherwise, why would further documents matter? Thy would simply rule to remand and be done with it.

This case is already getting aged by Court of Appeals "norms" and even by admission of the plaintiff's attorneys.

This not a "warm and fuzzy" situation for the appellants.
