The judge listened to both sides and "took it under advisement", indicating that there would be some ruling at some unspecified point in time. Didn't dismiss it, didn't NOT dismiss it - just sat on it with no indication of a time frame. No subsequent date set in this specific matter (motion to dismiss).

Entirely up to your interpretation now... :(

I think whichever way it was going to go it would've been a lot better if the judge had at least indicated some likely time frame for a ruling. I presume that he (Lonny Suko, I believe) is doing his research at his leisure, but time works very differently for lawyers and judges than for normal humans...
