Loop re Ericy's fall and Nokia's MFL clause

Ericy was specifically named in the original 1999 Nokia contract as one of the leading unlicensed MFL companies that upon licensing would provide the framework for Nokia's rate. I don't see how Nokia could argue against using a specifically named company, or its successor, just because Ericy does not quite have the same handset position as it did in 1999. BTW they have really not fallen that far as Sony/Ericy is still the fifth or sixth largest handset producer and Ericy still leads in infrastructure. Even though they are not quite as strong as they once were, they are still considered a first-tier leading manufacturer.
