As an example, if I were write "Seymour is a murderer involved in the unsolved murders of three prostitutes" then put that note in my friend Ed's mailbox, that would be highly illegal. If Ed then took that note seriously, and distributed it around and the stock price of NNVC collapsed 31% based on that distributed note, that would again make the author highly liable and at risk of criminal indictment -- regardless whether he did in with the deranged, misguided motive that it would help his company.

It is widely known criminal act falsely accuse somebody of a serious crime that never existed. The potential civil and criminal penalties only multiple when dealing with securities.

I have in my possession a confession that circulated a knowingly false story accusing NNVC of fraud, in detail, and was "wholly fabricated" by the author. Just like my analogy of making up a story that Seymour is a serial killer, the courts -- both civil and criminal -- do not care for one second if my knowingly false criminal accusation came from somebody who is "long NNVC," "short NNVC," or anything in between. A crime is a crime, and it's a crime to falsely accuse somebody of a serious crime such as fraud as CEO of a multi-hundred million dollar company.

On a side note -- how could this fellow been so sloppy and stupid and who helped in instead of warning him how serious of it crime it is to make up a story of fraud then confess to it with the idiotic thought that serious securities violation is all cool? Maybe the dude really is a genius was actually short the stock the whole time and is now living on his own private island with his illegal profits, safe from prosecution.
