What legal basis is there for overturning the very clear provision in the transaction documents in which both partied irrevocably relinquish their rights to trial by jury?

When it is 100% clear in the transaction documents Judge Oing follows what they say. The JV is a good example, Paul's argument for an oral JV was rejected because the transaction documents were crystal clear.

Please let us know what legal justification there is for even demanding such a thing in the first place as it looks like a frivolous filing to me. And further more what is going to convince Judge Oing to overturn the contract here, when he would not do it with the JV issue.
