TMMI bought DFI and they stated the only reason they did so was to acquire the only asset of DFI (the VDK2.0 codec) in 2012. In 2001 they were excited to be working with DFMI's new codec (TMMI press release). In 2002-3 they were involved in a court case in Ventura wherein Simpson stated DFMI owned the codec and in the settlement agreement the judge ordered him to "give it, and all copies" back to DFMI. TMMI's due diligence should have uncovered this.
In 1996 Iterated's and TMMI's lawyers battled it out in letters wherein Iterated's lawyer stated TMMI didn't have access to anything due to non-payments.
This discovery phase and deposition phase has been hard on TMMI (IMO).
